Erhebung des Impfstatus durch ArbeitgeberIn ist datenschutzrechtlich nicht gedeckt.

Die jüngsten Lockerungsschritte und neuen Sicherheitskonzepte werfen auch eine große Frage auf: Dürfen sich ArbeitgeberInnen nach dem Impfstatus ihrer MitarbeiterInnen erkundigen? „Nein“, antworten Christian Bergauer, Assoziierter Professor für Datenschutzrecht, und Petra Zandonella, Diplomandin und Studienassistentin, an der Universität Graz. „Es handelt sich nämlich um besonders schutzwürdige Angaben zur Gesundheit, die einem generellen Verarbeitungsverbot unterliegen“, beruft er sich dabei auf die europäische Datenschutz-Grundverordnung (DSGVO). Ein berechtigtes Interesse allein, wie es jüngst in den Medien berichtet wurde, reiche für die Erhebung von Gesundheitsdaten nicht aus. Im Übrigen würde es auch schon an der Erforderlichkeit einer derartigen Erhebung des Impfstatus scheitern, „da die Verhinderung einer Übertragung durch Geimpfte nach wie vor unsicher ist und es weitere Schutzmöglichkeiten wie Masken und Abstand gibt“, meint Bergauer.

Eine Ausnahme sei die ausdrückliche Einwilligung der betroffenen Person, die aber eine echte freie Wahl haben müsse. „Und das darf in solchen Fällen wohl bezweifelt werden“, ergänzt der Forscher. Alle weiteren hier in Betracht kommende Ausnahmen würden jedenfalls gesetzliche Grundlagen der Union oder der einzelnen Mitgliedstaaten verlangen. „Und die gibt es für private ArbeitgeberInnen aktuell in Österreich nicht“, stellt Bergauer fest.

Almost three-quarters would like to see more public funding for education, whilst only around three per cent are in favour of cuts in this sector.
